Terms of service

These terms govern the use of Aktum, an early-access service provided by Monadial s. r. o. They are written in plain language on purpose; the plain language is the agreement.

1. Who provides the service

The service is provided by Monadial s. r. o., with its registered seat at Majerníkova 3043/54, 841 05 Bratislava, Slovak Republic, company ID (IČO) 47 647 876, registered in the Commercial Register of the District Court Bratislava III, section Sro, insert no. 144751/B (“Monadial”, “we”). Contact: [email protected].

“Aktum” means the hosted service at app.aktum.io, the marketing site at aktum.io, the sidecar software you run on your own infrastructure, and the documentation. “You” means the organization that uses Aktum and each person acting through an account in it.

2. Agreement and eligibility

By creating an account, joining an organization, or using the service, you agree to these terms and to the privacy and data handling statement. If you use Aktum for an organization, you confirm that you are authorized to bind it, and these terms bind the organization.

Aktum is a tool for teams and businesses. It is not directed at consumers or at children, and you may use it only for your organization’s own work.

3. Early access

Aktum is a beta. That has consequences these terms state plainly rather than hide:

  • The service changes, sometimes without notice. Features appear, change and are removed.
  • No availability commitment is made. Each release of the hosted service causes a brief interruption, and no service level agreement exists.
  • Access is granted by invitation, per organization, and we may decline, limit or end early access at our discretion.
  • No certification (such as SOC 2 or ISO 27001) is held yet, and no data processing agreement is published yet.
  • The service is provided free of charge during the beta. If paid plans are introduced, they will apply only after you agree to them; nothing converts to a paid obligation by itself.

One thing does not change with the beta label: the record Aktum keeps for you is committed to your own repository as readable text, so your decisions stay yours and readable even if the service ends.

4. Accounts and security

You sign in with a verified email address, GitHub, Google (where configured) or a passkey, and every session requires a second factor. You are responsible for the accuracy of your account details, for the security of your sign-in methods and second factors, and for what is done through your session. Recovery codes are shown once; keep them safe. Tell us at [email protected] if you believe an account or a sidecar credential is compromised.

An organization’s administrators control its membership, roles, security policy, integrations and sidecars. Whoever holds the administrator role can act for the organization in the product, and the audit log records administrative actions.

5. Your content and the record

Your content stays yours. Everything you or your team bring to Aktum, and everything the record captures about your decisions, belongs to you: your repositories, documents, threads, decisions, approvals, signatures, policies, uploads and prompts (“customer content”). These terms transfer no ownership to us.

The license you give us. You grant Monadial the non-exclusive right to host, store, index, process, transmit and display customer content, only as needed to provide and secure the service and only for its duration. This includes committing the record to your repository under names carried in the content, uploading indexed repository text for indexing and review, and passing prompts from your infrastructure to the model endpoint you configured. We do not use customer content to train models, and we operate no model of our own.

Your responsibility for it. You confirm that you have the rights needed to bring the content to Aktum (including the rights to the repositories you connect and to any personal data inside them) and that the content does not violate law or third-party rights.

AI output. Machine-written text in Aktum is visibly provisional until a named person accepts it. Whether an accepted draft is correct, lawful or fit for your purpose is your review to make; the product is built so that a person decides, and these terms leave that responsibility where the product puts it.

6. The sidecar and your infrastructure

The sidecar runs on infrastructure you control, under credentials that stay on your side. You are responsible for that machine, its security and its access to your repositories, and for the model keys you configure. Repository write access exists only through the sidecar, branch and patch only; the sidecar software is provided to you for use with the service and remains Monadial’s software under section 9.

7. Third-party services

Aktum works with services that have their own terms between you and their providers: GitHub (through the GitHub App your organization installs and can revoke), your model providers (Anthropic, OpenAI, or any OpenAI-compatible endpoint, under your keys), and any repository hosting or infrastructure of your own. We are not a party to those agreements, and what those providers do with what they receive is governed by them. The subprocessors we use to run the hosted service are listed on the subprocessors page.

8. Acceptable use

You will not:

  • use the service to break the law, or bring content to it that you have no right to bring;
  • probe, overload or disrupt the service, or bypass its access controls, quotas or security measures;
  • access another organization’s data, or attempt to;
  • resell the service or offer it to third parties as your own;
  • misuse invitation, sign-in or early-access mechanisms, including automated form submissions.

Security research is welcome within the rules on the vulnerability reporting page. We may suspend access that endangers the service or other customers, and will say why when we do.

9. Monadial’s software and marks

The service, the sidecar software, the studio, the documentation and the Aktum name and mark remain Monadial’s. No rights are granted beyond what these terms state. Feedback you choose to give us about the service may be used to improve it without obligation to you; this covers opinions and suggestions, never your customer content.

10. Confidentiality

During early access you may see parts of the service that are not public. Each side will treat the other’s non-public information with reasonable care and use it only for the purposes of the beta. This does not restrict what the record in your own repository says about your own work, and it ends when the information becomes public without breach.

11. Warranties and disclaimers

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows. We do not warrant that the service is uninterrupted, error-free or secure, that defects will be corrected, or that AI-drafted content is accurate. Nothing in these terms excludes liability that cannot be excluded by law, including liability for intentional misconduct or gross negligence where Slovak law does not permit its exclusion.

12. Liability

To the extent permitted by law, Monadial’s total aggregate liability arising out of or related to the beta is limited to EUR 500, and neither side is liable for indirect or consequential damages, lost profits, lost data (except where caused by our breach of the privacy commitments), or business interruption.

Because the record is committed to your repository, the loss of the hosted cache does not lose your decisions; the parts of the service state that live only in Aktum’s database (runs, AI answers) are runtime state and carry no durability commitment during the beta.

13. Suspension and ending

You can stop using the service at any time; an organization administrator can ask us to delete the organization’s hosted data as described in the privacy statement. We may suspend or end early access with reasonable notice, or immediately where these terms are breached or the service’s security requires it, and we will say why.

When early access ends, for whatever reason: the record already in your repository stays there, under your control; the export endpoint remains the way to take the rest; and we delete the hosted data for your organization on request. Sections 5 (your ownership), 9 to 12 and 14 survive the end of the agreement.

14. Governing law and disputes

These terms are governed by the law of the Slovak Republic, excluding its conflict-of-law rules. Disputes belong to the courts of the Slovak Republic with local jurisdiction over Monadial’s registered seat, unless a mandatory law gives you a different forum. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

15. Changes and the rest

We may change these terms as the beta evolves. A change is a new dated version on this page; material changes are announced to organization administrators by email before they take effect, and continued use after the effective date is acceptance. If a provision is unenforceable, the rest stands. These terms and the privacy statement are the entire agreement for the beta and replace prior discussions. You may not assign this agreement without our consent; we may assign it to a successor of the business. Not enforcing a provision is not a waiver of it.
